Terms and Conditions

Welcome to URBUN Coffee GbR (“URBUN”). These Terms and Conditions (“T&Cs”) govern your use of our online shop at https://urbun-coffee.com. By accessing our platform, you agree to these T&Cs, compliant with GDPR and German consumer laws.

URBUN Platform

We operate an online shop for coffee products. Registration is optional for purchases but required for personalized offers via email, subject to your consent (Article 6(1)(a) GDPR). Prices include VAT, with shipping costs shown separately per § 312j BGB.

Scope of Terms
  • Acceptance: Using our services or registering indicates agreement to these T&Cs.
  • Access: View, download, or print these T&Cs via the Terms and Conditions link, per § 312j(2) BGB.
  • Exclusivity: User or partner terms do not apply unless agreed in writing by URBUN.
  • Language: The contract language is English.
Membership
  • Registration: Free and optional, with no purchase obligation. No legal entitlement to membership exists.
  • Data Accuracy: Provide accurate, complete data, including a valid email, per Article 5(1)(c) GDPR.
  • Single Account: One account per person. Violations may lead to termination.
  • Security: Keep passwords confidential. Report misuse to URBUN Support.
  • Data Retention: Inactive accounts may be deleted after six months, per Article 5(1)(c) GDPR.
  • Termination: Cancel anytime via email (Article 7(3) GDPR). URBUN may terminate with 14 days’ notice or immediately for breaches.
  • Data Rights: You have rights to access, rectify, erase, restrict, or port data, per Articles 15–20 GDPR. Contact URBUN Support.
Ordering and Contracts

Non-Binding Offers: Product descriptions are invitations to order, not binding offers (§ 145 BGB). Orders are for consumers (§ 13 BGB) in household quantities.

Order Process
  1. Add items to cart.
  2. Enter delivery and payment details.
  3. Accept T&Cs.
  4. Click “Place Order” to submit a binding offer.

Minors: Minors need legal representative consent (§ 107 BGB).

Contract Confirmation: An automated email confirms the contract (§ 312j(2) BGB). Goods remain URBUN’s property until paid.

Non-Delivery/Rejections: If goods are unavailable, we notify and refund you promptly (§ 312j(3) BGB). Orders may be rejected for delivery, quantity, or payment issues.

Platform Use
  • Availability: Services may be restricted for maintenance. Outages may occur without liability, except as required by § 312j BGB.
  • Prohibited Activities: Illegal activities, malware, offensive content, or spamming are forbidden (§§ 130, 131 StGB).
  • Third-Party Content: URBUN is not liable for third-party content but removes unlawful material upon discovery (§ 10 TMG).
Competitions and Promotions
  • Winners are notified via email.
  • Non-response may forfeit prizes.
  • Prizes are non-exchangeable and non-cashable.
  • Winners’ names may be published with consent (Article 6(1)(a) GDPR).
  • Manipulation leads to disqualification.
  • URBUN may cancel or extend promotions.
Referrals
  • Invitations: Members may recommend products with recipient consent (Article 6(1)(a) GDPR).
  • Consent Verification: Evidence of consent may be required (§ 7 UWG).
Promotional Coupons
  • Apply to specified products only.
  • Minimum order values may apply.
  • One coupon per order.
  • Non-transferable and non-cashable.
  • No refunds unless coupon was purchased.
  • Lost coupons are not replaced unless URBUN is at fault.
Warranty, Liability, and Returns
  • Warranty: Two-year statutory warranty applies (§§ 434–435 BGB).
  • Liability: Limited to intentional/gross negligence or essential obligation breaches (§ 309 BGB). Product liability remains unaffected.
  • Returns: Customers bear return shipping costs unless goods are faulty (§ 357(6) BGB). Refunds exclude shipping costs.
  • Cancellation Rights: 14-day cancellation right for distance contracts (§ 355 BGB). See Cancellation, Return, and Refund Policy.
Email Tracking
  • Data Sharing: Order data is shared with mail carriers for tracking (Article 6(1)(b) GDPR).
  • Purpose: Used solely for order delivery.
  • Consent: Ordering implies consent for tracking data sharing.
  • Security: Data is encrypted during transfer (Article 32 GDPR).
Indemnity

You indemnify URBUN against third-party claims from your violations of rights or T&Cs (§ 254 BGB).

Copyright

Content is protected by copyright (§§ 15–16 UrhG). Unauthorized copying or scraping is prohibited.

Final Provisions
  • Severability: Invalid clauses do not affect remaining T&Cs (§ 306 BGB).
  • Governing Law: German law applies, with consumer protections preserved (Article 6(2) Rome I).
  • Jurisdiction: Disputes are resolved at URBUN’s headquarters for merchants (§ 38 ZPO).
  • Dispute Resolution: We are not obliged to participate in ADR but provide the EU ODR platform: ODR Platform (§ 36 VSBG).
