§ 1 Internet Platform
URBUN Coffee (“URBUN”) operates the online shop at https://urbun-coffee.com. You do not need to be a member to visit the URBUN website (“user”). A user must not be a member to purchase products. A user must register to become a member (§ 3). You will receive personal information about impending sales campaigns via URBUN’s e-mail service, provided you have agreed to receive these e-mails. The prices shown on the website are final and include VAT. Freight costs will be shown separately in a manner comprehensible to you.
§ 2 Validity of the General Terms and Conditions
2.1 By declaring your agreement at the time of registration, you also declare your agreement with the application of these General Terms and Conditions (hereinafter referred to as “GTCs”). These GTCs define the conditions under which you may use the services provided by URBUN.
2.2 You can download, save, and print these GTCs at any time via the “GTC” link on the URBUN website.
2.3 The general terms and conditions of users, members, and partners will not apply to any direct business with URBUN, even if not explicitly refuted. This also applies if the user, member, or partner has prescribed a special format for filing objections. Deviating terms and conditions will not apply unless confirmed in writing in advance by URBUN.
2.4 The contract language is German.
§ 3 Registration, Termination, and Restriction of Membership
3.1 Registration is free. Registration and membership do not give rise to any purchase obligations. No legal entitlement to contract formation exists due to registration or membership.
3.2 Accurate and complete data are required at registration and throughout membership, including a valid e-mail address.
3.3 Only one registration per person is allowed. Circumvention may result in termination of membership.
3.4 Members must keep passwords confidential and report any abuse to URBUN immediately.
3.5 URBUN may delete inactive accounts or those with unreachable e-mails after 6 months.
3.6 Members may cancel membership at any time via e-mail.
3.7 URBUN may cancel membership with 14 days’ notice.
3.8 In case of legal violations or breaches of GTCs, URBUN may immediately block, restrict, or terminate membership without notice.
§ 4 Conclusion of Contract and Reservation of Title
Product descriptions do not constitute a binding offer but an invitation to order. Orders are accepted only for household-level quantities and directed at consumers. URBUN may apply conditions to sales.
Steps to place an order:
- Place item in basket
- Enter delivery/payment details
- Agree to GTC and cancellation policy
- Click “Place Order”
Clicking “Place Order” constitutes a binding offer. Minors require legal representative consent.
Upon order receipt, an automatic confirmation email is sent—thus concluding the contract. Goods remain URBUN’s property until fully paid. Claims must be reported immediately if third parties are involved.
If goods are unavailable, URBUN will notify and refund immediately. URBUN may withdraw from the contract if suppliers fail to deliver without URBUN’s fault.
URBUN reserves the right to reject offers for reasons such as delivery region, non-consumer status, excessive quantity, or payment failure.
§ 5 Use of the URBUN Platform
5.1 URBUN may restrict services for technical reasons or maintenance. Temporary system failures may occur.
5.2 Prohibited uses include, but are not limited to: illegal activities, youth-protection violations, malware use, unauthorized content upload, offensive/racist content, harassment, chain letters, and commercial spamming.
5.3 URBUN is not liable for third-party content or linked websites but will remove unlawful material upon discovery.
§ 6 Conditions Governing Competitions and Promotions
- Winners are selected from qualified participants
- Winners are notified via e-mail
- Failure to respond in time may result in forfeiture
- Prizes are non-exchangeable/non-cashable
- Winners’ names may be published
- Manipulation leads to disqualification
- URBUN may cancel or extend promotions
§ 7 Referrals and Recommendations
7.1 Members may invite others and recommend campaigns/products.
7.2 Only consented recipients may be referred. Evidence of consent may be required in disputes.
§ 8 Promotional Coupons
- Usable only on specified products unless otherwise stated
- Minimum value/order may apply
- One coupon per order
- Coupons are non-transferable, not redeemable for cash
- No refund if canceled unless coupon was paid for
- Lost coupons are not replaced unless URBUN is at fault
§ 9 Warranty, Liability, and Returns
9.1 Warranty follows applicable consumer laws.
9.2 URBUN’s liability is limited to intent/gross negligence, breach of key obligations, or health damage. Product liability remains unaffected.
9.3 Same applies to campaign participants.
9.4 Liability exclusions do not apply to explicit guarantees.
9.5 Return shipping is borne by the customer unless faulty. Refunds cover item value only, not shipping.
§ 10 Email Tracking
10.1 Data is shared with mail carriers for tracking.
10.2 Purpose is solely order tracking.
10.3 By ordering, you consent to this sharing.
10.4 URBUN is not liable for mail carrier delays but will support resolutions.
10.5 We protect your data during transfer.
§ 11 Disclaimer
Users indemnify URBUN against third-party claims due to rights violations or breaches. Users must cooperate fully and immediately in such cases.
§ 12 Copyright and Rights of Use
Content is protected and may not be copied or used without permission. Automatic scraping/copying is forbidden.
§ 13 Concluding Conditions
13.1 Invalid clauses do not affect the rest. Replacement clauses will reflect original intent.
13.2 German law applies. Consumer protections in your home country remain unaffected.
13.3 Jurisdiction is URBUN’s HQ for merchants or where no local jurisdiction exists.
13.4 Oral side agreements do not apply. All agreements must be in writing.
